Please tick the box accepting these Terms and Conditions before confirming your purchase. These Terms and Conditions apply to bookings and purchases from Clearwell Caves as set out in the confirmation email. We reserve the right to make changes to Activities and Events, or to cancel them if necessary. In the event of cancellation by us, a full refund will be made. If you need to cancel your booking we regret that we are unable to offer refunds for any Clearwell Caves Activities or Events so please make sure the details of your booking are correct at the time of booking and on receipt of your confirmation email and tickets. We willendeavor to alter the booking subject to availability.

These pages together with our Privacy Policy set out the terms and conditions upon which Clearwell Mine Management Ltd ("we", "us" or "our" "the Caves") provides Activities and Events at Clearwell Caves to you and your guests ("you" or "your") (the "Terms"). Please read these Terms carefully before buying a ticket to Clearwell Caves ("Ticket(s)"). By buying a Ticket and/or gift voucher, you agree to be bound by these Terms.

These Terms apply to the sale of Tickets only and do not apply to the sale of products from our Shop.

Clearwell Caves is an ancient iron mine, now a working mining museum offering various Activities and Events throughout the year for which we sell advance tickets. The Caves Activities and Events are based around the old workings of the mine so the pathways in the mine are steep and wet in parts (depending on the weather), so please come prepared wearing stout footwear with flat soles and good grip.

How to Purchase Tickets

Activity or Event Tickets may be purchased via our website www.clearwellcaves.com/events.html or by telephone (01594 832535). Please be aware that some Activities and Events at the Caves are by pre-booked ticket only.

Payment must be made in full at the time of booking either by credit card or debit card. We also accept cheques or cash, if booking in person at the Caves.

Booking confirmation.

Online bookings will receive confirmation by email. No online booking will be accepted unless in writing from Clearwell Caves, including a confirmation email. You must advise Clearwell Caves as soon as possible of any mistake in the booking confirmation. We will endeavour to ensure participation for you and your party as booked, if practical, or offer an alternative event if available. It is the responsibility of participants to ensure they arrive in sufficient time. Late arrivals may not be able to participate in the activities booked or may be offered an alternative time if appropriate. Late arrivals will not be permitted to undertake activities and no refunds or compensation will be payable in such circumstances.

Cancellations

Where we are unable to offer the booked activity for whatever reason we will endeavour to contact you to cancel the activity as soon as we become aware of the need to cancel and offer alternatives where applicable or a full refund of the cost of the activity at the price paid for the booking. Clearwell Caves will not be liable for any other compensation.

We reserve the right to refuse entry or remove from any event or activity persons who in our judgement are conducting themselves in a manner or are in a condition that is likely to endanger health and safety of yourself, other people, or we consider to be disruptive. We reserve the right to refuse admittance or remove a participant from activities or events should we deem it necessary to do so. This includes any participant who does not comply with the safety rules and advice from instructors. No refunds or compensation will be payable by Clearwell Caves. Where a deposit has been paid at the time of booking, if you subsequently do not confirm, or choose to cancel the booking any deposit is non-refundable. In the event that it proves necessary to close or cancel any activity for reasons beyond the control of Clearwell Caves or in circumstances where your party has commenced participation in activities, you shall not be entitled to any refund (in part or in whole). In such circumstances Clearwell Caves may but shall not be obliged to offer alternative dates or times.

Price and Payment

Subject to any terms agreed in writing between Clearwell Caves and you, our charges shall be calculated at our current rate as shown on our official website www.clearwellcaves.com and payment in full is due at the time of booking. The charges include the cost of purchasing the activity or goods and include VAT at the current rate. Postage and packaging for products ordered will also be added at cost, if requested with your order. Where multiple forms of payment have been used Clearwell Caves reserves the right to refund any card payments back to the card used, any more monies due on the refund or amendment, may be refunded by using credits or cheque. Once purchase has been made, no other offers can be used in conjunction with the purchase. No ticket may be resold. Any online offers or discounts are for limited quantities and periods only and may not be available on bookings made by phone or in person. Please bring along your booking reference number and/or email printout to gain entry. Prices are correct at the time of publication and are subject to change without notification. Please note that access to Clearwell Caves can be limited during special events. Please check availability, event descriptions and any closures on our official website www.clearwellcaves.com before you travel.

Where Ticket prices vary according to age, the following provisions will generally apply:

• A person of 16 years or older is classed as an Adult;
• A person aged between 5 and 16 years (inclusive) is classed as a Child; and
• For children aged 4 and under no admission fee will be charged.
• Persons with a valid student card will be eligible for Concession rate
• Persons in receipt of a state pension are eligible for Concession rate.
• A Child on a Deep Level trip is anyone aged 7-17years old.
• Children on Deep Level trips must be accompanied by a responsible adult.
Prices for special Events or Activities and the qualifying ages will vary depending on the Event or Activity. This particularly applies to Deep Level visits and our Christmas Fantasy Event. See the Events pages for more details.

Group tickets for parties of fifteen or more may be available at discounted rates. Please contact our telephone booking line (01594 832535) for more information.

The price of Tickets will vary from time to time. Our prices are as stated on our website but are liable to change at any time. When buying a Ticket either via the website or by telephone, the total price will be confirmed. We reserve the right to correct any pricing errors even after we have sent you the email confirmation or Tickets (as appropriate) although we will endeavour to do so as soon as we become aware of the error.

Ticket prices are in UK Sterling and include VAT at the current rate.

Tickets – General Terms

One Ticket purchased entitles one person entry to the Caves Activity or Event on a single occasion. Once you have exited the Caves Activity or Event, you will need to purchase a new Ticket to re-enter the Caves an Activity or another Event.

All persons entering the Caves for an Activity or Event must hold a valid Ticket that must be retained at all times and must be available for inspection if required by any member of staff. Failure to produce a valid Ticket on request may result in your removal from the Caves Activity or Event.

Tickets remain the property of the Caves at all times. We reserve the right to require the immediate return of the Tickets at any time and to refuse entry to or eject from the Caves Activity or Event, any person who fails to comply with these Terms.

Once acquired, whether by purchase or on a complimentary basis, Tickets are non-refundable, non-transferable and void if altered. Tickets that we reasonably suspect have been transferred or altered will not be honoured. Tickets are not for resale. Any such resale shall have the effect of rendering that Ticket void.

Tickets will include entry to the Activity or Event described, but not necessarily to all areas of the Caves, as we may have to close areas off for safety or to allow maintenance and updating. Subject to availability and at our absolute discretion, visitors may be asked to purchase additional tickets to obtain access to extra activities.

From time to time, we may decide at our absolute discretion to issue tickets under special promotions ("Promotional Tickets") but Promotional Tickets will be available subject to availability and subject to any terms and conditions affecting the particular promotion.

Ticket Delivery

Tickets bought by telephone, you have the option to collect in person or choose to have Tickets posted by first class post to the address you provided during the booking procedure. The postage option is only available when the booking is made at least seven (7) days before the date of your planned visit to the Caves. We take no responsibility should you not receive the Tickets due to the failing of the Post Office or other third party delivery service. There is a £1.50 fee for postage and packing of your tickets if you chose this option.

Allocated Entry Time

You will be given the opportunity to select a date and time for arrival at the Caves for an Activity or Event (an "Allocated Entry Time") (subject to availability) during the online or telephone booking procedure and this will be shown on your confirmation email or Ticket (as appropriate). For those wishing to redeem a valid gift voucher, please call 01594 832535 to arrange your Allocated Entry Time. It is your responsibility to arrive in time for your Allocated Entry Time.

You are asked to arrive at the Caves no later than 20 minutes before your Allocated Entry Time although you will not be allowed access into the Caves Activity or Event before your Allocated Entry Time.

Visitors who miss their Allocated Entry Time are not guaranteed entry to the Caves Activity or Event. Clearwell Caves staff will advise visitors who have missed their Allocated Entry Time of the next available time slot but at busy times it may not be possible to find a time on the same day in which case it will be necessary to re-book an Allocated Entry Time.

Once an Allocated Entry Time has been issued, it will be necessary to call 01594 832535 for you to change the day and/or time of entry into the Caves or Event. A charge of £10.00 will be applied every time a booking is changed.

We reserve the right to amend an Allocated Entry Time once it has been issued to you but we will endeavour to notify you as soon as we become aware that this is necessary. Should we have to significantly amend your Allocated Entry Time (i.e. by four (4) hours or more), you may choose to accept the new Allocated Entry Time, arrange another mutually agreeable Allocated Entry Time with us via our telephone booking line or cancel the Ticket whereupon we will refund you all the monies you have paid to us for the Ticket(s) but no further compensation will be paid.

Gift Vouchers

Gift vouchers may be available for purchase via our website.

A gift voucher entitles one person to visit the Caves, to undertake an Activity or Event and is valid for one year from the date of purchase. Before visiting the Caves Activity or Event, the gift voucher holder must phone the booking line (01594 832535), to book his or her Allocated Entry Time. Timeslots are subject to availability. All children under 16 must be accompanied by an adult.

Please be aware that only one gift voucher recipient can be entered per transaction. If you are intending to send gift vouchers to different addresses please book each one as a separate transaction.

Please protect the gift voucher and treat it as cash. We cannot be held liable for gift vouchers which, are subsequently lost, stolen or damaged.

Ticket Cancellation

Should you wish to cancel a Ticket, you must notify us immediately by telephone on 01594 832535 upon which the email confirmation or Tickets shall become void. Tickets are non-refundable. We are under no obligation to issue refunds where a Ticket has been cancelled by you and the Cave Activity or Event is operating as normal but, notwithstanding this, any refund that may be offered shall be entirely at our discretion.

In rare circumstances beyond our control, we reserve the right to cancel a Ticket but we will endeavour to notify you as soon as we become aware that this is necessary. Should we have to cancel your Ticket we will refund you all the monies you have paid to us.

Customers who have purchased a gift voucher and/or product, from our website and are resident in the European Union are entitled to cancel their purchase within seven (7) business days from the date of purchase and receive a refund. This right to cancel does not apply to pre-booked Tickets. Should you wish to cancel your purchase please contact us by telephone on 01594 832535.

Disabled visitors

The Caves are not easily accessible by people with walking difficulties the practicality of such a visit depends on the person involved. We encourage a free advance visit by a carer to assess suitability before the actual visit.

Underground access is possible for wheelchair users but the terrain is difficult and requires two able bodied persons to push/pull the chair through in many places. We encourage the helper/s to investigate the route (free of charge) to assess suitability before the proposed visit.

Carers are entitled to 50% discount if accompanying a wheelchair user or when accompanying a disabled person, on presentation of a Carers Card or official letter of proof.

Other websites

We may provide links on our site to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking that products you purchase from third party sellers whose website we have provided a link on our site, will be of satisfactory quality, and any such warranties are disclaimed by us absolutely. This disclaimer does not affect our statutory rights against the third party seller.

Children

Children (under 16 years of age) must be accompanied by a person aged 16 years or over whilst in the Caves or undertaking an Activity/Event or in the vicinity of the underground areas. Such children shall remain under the control and supervision of a person aged 16 or over at all times.

Prices and ages applicable to children will vary with the Activity or Event. Please check with our website at the time of your booking.

Health and Safety

A variety of special effects (including smoke machines, sudden loud effects and strobe lighting) may be used in certain areas within the Activities or Events. It is recommended that visitors with high blood pressure, heart conditions or other pre-existing medical conditions ask the Caves staff for further details and if unsure avoid activities at which such special effects are used.

From time to time the Caves staff may draw visitors' attention to certain health and safety procedures to which visitors must adhere, including use of safety equipment or fire evacuation.

Your Conduct

Whilst You and other Ticket holders undertake Activities or Events, you and your guests must comply with all directions of our staff, relevant health and safety notices, policies and announcements made available to You. Do not go beyond barriers or climb on rocks or walls, unless instructed by a member of Cave staff.

Any breach of any of these Terms or any unacceptable behaviour by You or your guests that is likely to cause damage, nuisance, injury to any other visitor or member of our staff or to the Caves itself shall give rise to the right of the Caves staff to eject you immediately from the premises.

We shall have the right to refuse admission or to eject you and any other Ticket holder from the Caves if in our reasonable opinion, granting you admission might be a risk to our property, the safety of others and/or affect the enjoyment of the Caves Activity or Event by others and in particular (but without limitation) where there is a breach of the following rules:

• No smoking;
• No pets or animals underground except for pre-arranged guide dogs and hearing dogs;
• No consumption of food or drink outside the designated areas without our express permission;
• No offensive weapons;
• No access to any area of the Caves other than areas designated for access by Visitors;
• No unnecessary noise (whether from mobile phones or personal stereos or otherwise) or behaviour likely to annoy or offend other visitors or intimidate the Cave staff;
• No use of illegal drugs.
• No consumption of alcohol except at authorised places and Events under licence by the Caves.
Security

In the interests of safety, you may be asked to submit to a search of your person or belongings and anyone refusing to submit or found to be in possession of materials which we believe to be dangerous or unsuitable will be denied entry or removed from the Caves.

You must keep your personal belongings with you at all times, or securely locked in lamp room if undertaking a Deep Level activity. In the absence of any negligence or other breach of duty by us, we accept no responsibility for loss, theft or damage to any personal belongings brought onto the Caves premises.

We will endeavour to make dedicated car parking available for use by those holding valid Tickets to the Caves free of charge but we accept no responsibility for any lack of dedicated parking availability, you are still required to arrive in time to be ready to enter the Caves at the correct time of entry shown on your ticket. We accept no responsibility for loss, theft, or damage to any vehicle (or its contents) while parked within our property.

Photography

From time to time we or other authorised third parties may carry out photography and/or other recording at the Caves and any images and/or recordings may feature visitors. You consent to the use of such images and/or recordings by us in connection with advertising, promoting the Caves (such as on the Clearwell Caves website, social media sites and pages, partner sites, outdoor advertising and brochures), and for our internal purposes, and in doing so, you allow us to edit, modify, publish and make available such images and/or recordings. You acknowledge and agree that you will not receive compensation if we use such images and/or recordings for the purposes set out above. If any visitors to the Caves are under 18, you, being the parent or legal guardian of such persons, also consent to the use of their image and/or recordings for the purposes set out above. You acknowledge that the copyright in such images and/or recordings rests with us and/or any authorised third party and accordingly you grant us and/or any authorised third party all rights in any images and/or recordings of you and/or your children. You shall promptly execute such documents and perform such acts as may be required for the purposes of giving full effect to the foregoing.

The taking of photographs with handheld cameras is allowed in all areas of the Caves without permission apart from within Theatre Events. The use of flashes, tripods and other specialist photographic equipment requires specific permission. Photographs are for you to enjoy for your own personal, private, non-commercial purposes only. Commercial uses require specific permissions. Unless permission has been granted by us, picture and images cannot be reproduced in any format or media other than for private viewing.

Cameras or equipment used in the Caves particularly on caving activities may suffer damage, in the absence of any negligence or other breach of duty by us, we accept no responsibility for loss, theft or damage to any personal belongings brought onto the Caves premises.

Trademarks and Copyrights

The materials incorporated within the Caves Activities and Events including, without limitation, any sets, props, wardrobe, text, graphics, images, artwork, illustrations, photographs, booklets, animations, music, video, audio, audiovisual works, designs, logos, software and any other content (together, "Material") are protected by copyrights, patents, trade secrets or other proprietary rights owned by us and/or our licensors and/or Heather Holland ("Intellectual Property Rights"). Some of the characters, logos or other images incorporated within our Events including our Christmas Fantasy are also protected as registered or unregistered trademarks, trade names and/or service marks owned by us or Heather Holland "Trademarks").

Availability of Clearwell Caves Activities and Events

You are reminded that from time to time parts of the Caves may be closed and certain exhibits may be removed for maintenance or for technical reasons. Tickets will not be refunded and no compensation will be paid in the event of any such closure or removal.

We will use our reasonable endeavours to be open and operational during published opening hours but in exceptional circumstances reserve the right to close the Caves on any given day, whether for security or any other reason, without notice. In the event of such closure, any Tickets issued for use only on the day of closure will be exchanged or refunded by Clearwell Caves at the price paid for them but no further compensation will be paid.

Events Outside Our Control

Subject to applicable law, we shall have no liability to You if we are prevented from, or are delayed in performing our obligations under any contract or from carrying on our business by acts, events, omissions or accidents beyond our reasonable control, including (but not limited to) strikes, lock-outs or other industrial disputes (whether involving our employees or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, terrorism, malicious damage, compliance with any law or government order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, weather (flood, storm, snow etc) or default of suppliers or subcontractors.

How we use your personal information

We only use your personal information in accordance with our Privacy Policy. For details, please see our Privacy Policy. Please take the time to read these, as they include important terms which apply to you.

Variation

We have the right to revise and amend these Terms from time to time by notifying you or placing updated Terms on the website. You may not vary these Terms unless agreed in writing with us. You will be subject to the Terms in force at the time that you bought Tickets to the Caves Activity or Event. You may wish to print a copy of these Terms with a date-stamp for future reference.

Waiver

If we fail, at any time, to insist upon the strict performance of any of your obligations under any of these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

Entire Agreement and Miscellaneous

If any of these items are determined to be illegal, invalid or otherwise unenforceable it shall be severed and deleted from these Terms and Conditions and the remaining terms shall survive, remaining in full force and continue to be binding and enforceable. Nothing above shall confer on any third party any benefit or the right to enforce any of these Booking Terms and Conditions. These Terms and Conditions shall be governed by and interpreted with the laws of England and Wales. Clearwell Caves and you submit to the exclusive jurisdiction of the courts of England and Wales.

Upon purchase of a Ticket from our website, you will receive an email with a Ticket reference number.

This email constitutes your proof of purchase. Please check that you have received this email following purchase. We take no responsibility should you not receive this email due to reasons beyond our control e.g. blocking, junk or spam filtering. The confirmation email together with the credit card used to pay for the Tickets (or, if the card holder is not attending, a signed letter of authorisation from the card holder) must be presented at the main entrance with your ticket.

It is your responsibility to check the accuracy of the details on your email confirmation and Tickets as soon as received (as appropriate) as mistakes cannot always be rectified later. When you receive your email confirmation or Tickets, please keep them in a safe place as we cannot be held responsible for Tickets that are lost or stolen.

Only Tickets purchased directly from us are valid for admission. Tickets purchased from unauthorised third parties, including online auction sites, are not valid for entry.

Our liability for losses you suffer as a result of us breaching a contract between us is strictly limited to the purchase price of the Tickets you booked. This does not exclude or limit in any way our liability for death or personal injury caused by our negligence or that or our employees (if acting within the course of their employment), agents or suppliers (if carrying out the work which they were contracted to do); or any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

We are not responsible for indirect losses which occur as a side effect of the main loss or damage, or for any losses that fall into the following categories: loss of income or revenue, loss of business loss of profits or contracts, loss of data or waste of management or office time, loss of goodwill, disappointments or emotional distress and/or any other loss or damage which was not reasonably foreseeable by us at the date the Ticket was bought, however arising and whether caused by tort (including negligence), breach of contract otherwise, even if foreseeable.

Where part of the services you have paid for in connection with a Caves Activity or Event are provided by a third party supplier, that supplier's individual liability will be set out in their own terms and conditions. For the avoidance of doubt, we do not accept liability for acts or omissions by you or any person(s) on behalf of whom you have placed a booking or unconnected third parties or suppliers of services which do not form part of the contract between you and us.

These Terms and any document referred to in them constitutes the whole agreement between us and supersedes all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these Terms.

You acknowledge that, in agreeing to these Terms, you do not rely on any representation or warranty (whether made innocently or negligently) that is not set out in these Terms. Nothing in this clause excludes liability for fraud.

Law and Jurisdiction

These Terms are governed by English law. Any dispute arising from, or related to, such Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
